Home Rule Chapter 1100 - Parking and Storage of Certain Types of Vehicles and Equipment

WHEREAS, Ohio Revised Code §504.04 authorizes the Plain Township Board of Trustees to exercise powers of local self government and to adopt and enforce within the Township local police, sanitary, and other similar regulations; and

WHEREAS, Ohio Revised Code §504.05 authorizes the Plain Township Board of Trustees to impose a civil fine for a violation of a resolution adopted under Ohio Revised Code 504; and

WHEREAS, it has been determined that the parking and storage of commercial construction equipment, semi-tractors and/or tractor trailers, and all other commercial vehicles that exceed 26 feet in total length in any residential district within Plain Township has a potential to be a safety hazard within the Township; and

NOW THEREFORE, BE IT RESOLVED by the Board of Trustees of Plain Township, County of Stark, State of Ohio, pursuant to Chapter 504 of the Ohio Revised Code and within the authority of limited-self government that the following legislation is hereby adopted regulating the parking or storage of commercial construction equipment, semi-tractors and/or tractor trailers, and all other commercial vehicles that exceed 26 feet in total length in any residential district within Plain Township, and the corresponding fines for a violation thereof must take effect and to be enforced from and after the earliest period allowed by law:

Section 1101 - Prohibition on the Parking and Storage of Certain Types of Vehicles and Equipment Within any Residential District Within the Township

  1. No person or entity shall park or store, or cause to be parked or stored, any commercial construction equipment, semi-tractor and/or tractor trailers, and/or any other commercial vehicle in excess of 26 feet in total length in any residential district within Plain Township.
  2. Whoever violates this Section is subject to a fine of $25 for the first violation, and a fine of $100 for the second and each subsequent violation.

Section 1102 – Prohibition on the Storage of Junk Motor Vehicles Within Plain Township

  1. No person or entity shall park or store, or cause to be parked or stored, any junk motor vehicle outside of an enclosed garage or enclosed parking area within Plain Township.
  2. For the purposes of this Home Rule Legislation “Junk Motor Vehicle” shall have the same definition as contained in Ohio Revised Code section 505.173(E). As used in this Home Rule Legislation a “junk motor vehicle” means a motor vehicle that meets all the following criteria:
    1. Three model years old, or older;
    2. Apparently inoperable;
    3. Extensively damaged, including but not limited to, any of the following: missing wheels, tires, engine, or transmission.
  3. Whoever violates this Section is subject to a fine of $100 for the first violation, and a fine of $500 for the second violation, and $1000 for the third and each subsequent violation.

BE IT FURTHER RESOLVED, that this resolution be duly recorded and authenticated by the signature of the Township Clerk and the Plain Township Board of Trustees shall hereby advise the Clerk to publish same in a newspaper of general circulation within the Township according to the requirements of ORC 504.11 and 504.12.
