WHEREAS, ORC 504.04(A) authorizes the Township to exercise powers of local self-government within the local police, sanitary and other similar regulations and;
WHEREAS, OR CURRENT RESIDENT 504.05 authorizes the Plain Township Board of Trustees, Stark County, Ohio to impose a civil fine up to $1,000 for a violation of a resolution adopted under ORC 504 and;
WHEREAS, it has been determined that unauthorized persons trespassing within storm drainage pipes and culverts within Plain Township is a safety hazard within the Township;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, pursuant to Chapter 504 of the Ohio Revised Code, within the authority of the limited self-government, that we hereby adopt the following prohibitions pertaining to storm drainage pipes and culverts located within Plain Township and the corresponding fines for violations thereof to take effect and to be enforced from and after the earliest period allowed by law.
Section 201 - No Unauthorized Persons in Pipes and Culverts
No unauthorized person shall enter into or unto storm drainage pipes or culverts located within Plain Township.
Section 202 - Parent or Guardian's Responsibility
No person being the parent, guardian, custodian or other adult person having custody or control of any minor child shall allow or permit such minor child to enter or shall neglect to restrain or prevent such a minor child from entering into or onto the storm drainage pipes or culverts located within Plain Township.
Section 203 - Penalties
Whomever violates Section 201 or Section 202 is subject to a fine of $25 for the first violation, and a fine of $100 for the second and each subsequent violation.
BE IT FURTHER RESOLVED that this resolution be duly recorded and authenticated by the signature of the Township Clerk and the Plain Township Board of Trustees shall advise the Clerk to publish same in a newspaper of general circulation with the Township according to the requirements of ORC 504.11 and 504.12.
